Terms of Service

1. Agreement & Acceptance

By creating an account or using AdsNord Snap ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. AdsNord reserves the right to modify these Terms at any time. Continued use of the Service following changes constitutes acceptance of the new Terms.

2. Service Description

AdsNord Snap is a white-label SaaS platform that enables business owners (Subscribers) to:

• Create branded landing pages for selling photo magnets
• Accept customer orders and manage photos
• Track orders in a real-time dashboard
• Send automated notifications via WhatsApp and SMS
• Integrate with payment processors (Stripe, Razorpay)

The Service is provided "as-is" and is intended for business use only.

3. Account & Registration

To use AdsNord Snap, you must create an account by providing:

• A valid business name
• A valid email address (for account recovery and notifications)
• A secure password (you are responsible for keeping this confidential)
• Optional: business logo or branding

You represent and warrant that you are at least 18 years old and have the authority to bind your business to these Terms. You are responsible for all activity on your account. If you suspect unauthorized access, contact us immediately at info@adsnord.com.

4. Subscription Plans & Pricing

AdsNord Snap offers three subscription tiers:

• Starter: $49/month (annual: $39/month) — 1 landing page, 2 templates
• Growth: $129/month (annual: $103/month) — 10 landing pages, 5 templates, batch printing
• Scale: $299/month (annual: $239/month) — Unlimited landing pages, all templates, dedicated support

Pricing and features are subject to change upon 14 days' written notice. Annual billing provides a 20% discount and is non-refundable.

5. Payments & Billing

• Billing occurs monthly on your account creation date (or annually if selected)
• Payment is processed through Stripe or Razorpay — we do not store credit card data
• Failed payments will result in account suspension after 3 days
• Refunds are not provided for partial-month usage or unused features
• You may update billing information in your account dashboard at any time

6. User Responsibilities & Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Upload content that infringes on intellectual property or privacy rights
• Engage in harassment, hate speech, or defamatory content
• Attempt to hack, disrupt, or gain unauthorized access to the Service
• Use the Service to send unsolicited commercial messages or spam
• Resell or redistribute the Service without authorization

Violation of these terms may result in account suspension or termination without refund.

7. SMS Messaging Terms

By using AdsNord, you understand and agree to the following SMS messaging terms:

• Transactional Only: AdsNord uses SMS exclusively for transactional communications (order updates, confirmations, notifications). We do not send marketing or promotional text messages.
• Explicit Consent Required: You will receive an SMS only after providing explicit written consent via checkbox during checkout. This consent must be renewed for each new account or business profile.
• Service Provider: SMS messages are sent through Twilio, a third-party SMS provider. By accepting these Terms, you agree to Twilio's service terms and understand that your phone number will be shared with Twilio for message delivery only.
• Opt-Out Rights: You can opt out of SMS notifications by replying "STOP" to any message. Opting out does not cancel your service or subscription; it only disables text message notifications.
• Carrier Charges: Standard SMS rates from your mobile carrier may apply. AdsNord is not responsible for carrier charges.
• Data Security: Your phone number is treated as sensitive personal data and is stored securely. AdsNord does not sell, share, or disclose phone numbers except to Twilio for message delivery.
• No Guarantee of Delivery: While we use a reliable SMS provider, AdsNord does not guarantee SMS delivery due to factors beyond our control (carrier delays, network issues, etc.). Critical notifications are also available in your account dashboard.

8. Intellectual Property Rights

• Our Content: AdsNord retains all rights to platform code, design, logos, and documentation. You may not copy, distribute, or modify these materials without written permission.
• Your Content: You retain all rights to logos, photos, and business content you upload. You grant AdsNord a non-exclusive license to use this content solely to operate the Service (displaying your landing page, processing orders, etc.).
• End-Customer Photos: You represent that you have the right to accept and store customer photos on behalf of your business. You agree to obtain proper consent from customers before collecting their images.

9. Limitation of Liability

To the fullest extent permitted by law, AdsNord shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of revenue, profits, data, or business opportunities
• Third-party claims or service provider failures (Stripe, Twilio, Meta, etc.)
• Unauthorized access or data breaches resulting from third-party negligence

Our total liability under these Terms shall not exceed the fees you paid in the past 12 months.

10. Warranties & Disclaimers

Disclaimer: The Service is provided "as-is" and "as-available" without warranties of any kind, express or implied. AdsNord does not warrant that the Service will be error-free, uninterrupted, or secure.

Third-Party Services: AdsNord is not responsible for the availability, performance, or security of third-party services (Stripe, Twilio, Meta, Cloudflare, etc.). We recommend reviewing their terms and policies.

11. Termination & Cancellation

• Cancellation by You: You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of your current billing period. No refunds are issued for early cancellation.
• Termination by AdsNord: We may suspend or terminate your account immediately if you violate these Terms, engage in fraud, or pose a security risk. Termination may be without notice at our sole discretion.
• Data After Termination: Upon termination, your data (orders, photos, settings) will be retained for 90 days, after which it is permanently deleted. You may request a data export before deletion.

12. Dispute Resolution

If you have a dispute with AdsNord, we encourage you to contact us at info@adsnord.com to attempt informal resolution. If informal resolution fails, disputes shall be governed by the laws of Sweden and resolved in the courts of Skövde, Sweden.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Skövde, Sweden for resolution of any disputes.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make changes, we will:

• Update the "Last updated" date at the top of this page
• Send email notification to all active subscribers at least 14 days before material changes take effect
• Display a notice on our platform for the 30 days following significant updates

Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the new Terms, you must cancel your subscription before the changes take effect.
